Terms and conditions of sale
Payment terms: By submitting an order for a product or service with Visiongain Ltd and Visiongain Inc., the customer agrees without limitation or qualification to complete the transaction. The customer expressly acknowledges and agrees that Visiongain Ltd and Visiongain Inc. can withhold the product or service as a result of non-payment within the agreed credit terms of 30 days. Payments may be made by credit or debit card or by wire transfer. Customer is responsible for all bank charges relating to the wire transfer. If the dispatch of an order cannot be fulfilled or is delayed, the customer will be notified. To qualify for report discounts, payment must be made within 30 days of invoice date.
*A late fee of 2.5% will be automatically added to all over-due payments.
An admin charge of up to £50 may be applied to any amendment of invoice such as date or address change, or a refund. All our prices are exclusive of VAT and default currency for invoicing is GBP. All transaction charges are the responsibility of the client. We do not accept cheques.
Late Payment Visiongain Reports Ltd and Visiongain Inc. relies on the Late Payment Act and reserves the right to claim all reasonable out of pocket expenses from a debtor if third parties are used for debt collection purposes.
Refund and Cancellation Policy: Refund and Cancellation Policy: The descriptions of the products and services sold on visiongain.com are as complete and accurate as possible, and customers are encouraged to read all available information about a product before placing an order. Due to the nature of the information being sold, orders for reports cannot be cancelled.
Limitation of Liability: To the fullest extent permitted by applicable law, neither Visiongain nor any of its directors, employees, affiliates or other representatives will be liable for loss or damages arising out of or in connection with use of, or inability to use, the Products, Materials, Software and/or facilities or services offered by Visiongain, including, but not limited to, indirect or consequential loss or damages, loss of data, income, profit or opportunity, loss of or damage to property and claims of third parties, even if Visiongain has been advised of the possibility of such loss or damages, or such loss or damages were reasonably foreseeable.
Report Licenses: By submitting an order for a product or service on visiongain.com, the customer agrees and represents that they are buying for their own internal use only, and not for resale or export. Once you have opened a Visiongain Reports Ltd and Visiongain Inc. report, due to the nature of the product, you would have an irreversible contractual obligation to pay. Use of any report ordered on visiongain.com is also bound by the license types below:
Single User License: This license allows for use of a report by one named person, explicitly confirmed at point of sale. This person may use the report but may not share the report (or any information contained therein) with any other person or persons. Unless a Team License, a Site License or a Enterprise License is purchased, a Single User License must be purchased for every person that wishes to use the report within the same enterprise. The license is valid for 12 months from the date the report is sent. Customers who infringe these license terms are liable for damages which may easily exceed £15,000. You may not print a single user licence, should you wish to print a copy of the report, you would need to upgrade to a Team licence or above. The report is in PDF format.
Team License: This license allows for use of a report by six people within the same enterprise location. You may print a copy of the report under each user. Each of these people may use the report but may not share the report (or any information contained therein) with any other person or persons. Visiongain provides a service whereby we print, bind and ship a hard copy report for you, in full colour for a fee of £300 + VAT. But this service is only available for clients who purchase a Team licence or above. The license is valid for 12 months from the date the report is sent. Customers who infringe these license terms are liable for damages which may easily exceed £15,000. The report is in PDF format.
Site License: This license allows for use of a report by an unlimited number of people within the same enterprise location. Each of these people may use the report on any computer, and may print out the report, but may not share the report (or any information contained therein) with any person or persons outside of the enterprise location. There is no time limit access to the report. Customers who infringe these license terms are liable for damages which may easily exceed £15,000. The report is in PDF format.
Enterprise License: This license allows for use of a report by an unlimited number of people within the same enterprise worldwide. Each of these people may use the report on any computer, and may print out the report, but may not share the report (or any information contained therein) with any other person or persons outside of the enterprise. Datasets refers to the Excel spread sheets that we have formulated and which details the global, regional/national and submarket forecast data as shown within our reports. There is no time limit access to the report. Customers who infringe these license terms are liable for damages which may easily exceed £15,000. The report is in PDF format.
Global License: This license allows for use of a report by an unlimited number of people within the same enterprise worldwide. Each of these people may use the report on any computer, and may print out the report, they may also share the report (or any information contained therein) with any other person or persons inside the enterprise and its subsidiaries or parent company. This is the only license also that allows the company to share the information with external consultants. Datasets refers to the Excel spreadsheet that we have formulated and which details the global, regional/national and submarket data as shown within our reports. Multiple Report Packages: Many Visiongain loyalty clients buy a multiple reports package. License rules vary based on the type of report licences chosen on the package deal. However, the timeline in which the client can call their reports will be limited to a 2 year period. After that 2 year cut off period has ended, the client will need to renew their package to call for any more reports, regardless as to how many reports are still left uncalled from their original reports package.
Library Access: The library access is limited to 12 months and four users. Unless Visiongain is given written notice of at least three months, the 12-month contract will automatically renew each year.
